In the article, the attorneys define guardianship as having full legal authority and responsibility to make decisions for a child under 18-21 years old. An individual can also apply for guardianship of a younger person up to 21 years old if the younger person consents.

The guardianship process is very similar to legal custody and adoption except for the fact that guardianship is not a permanent relationship. Unlike adoption, guardianship can end when the child reaches the age of majority, when the child marries, or if the child passes away.

According to the New York family law attorneys, “Adult relatives, close family friends, and child protective agencies can make all petitions for guardianship. Guardianship may be granted in a variety of situations. For example, if both of a child’s parents die, the child may need a guardian. Or, if one or both parents are deported but the child remains in the U.S., a guardian may be needed for their welfare.”

Guardianship may also be approved by the court if a child is being abused or the child is living in an unstable living environment. In some cases, the parents and the child must consent to guardianship, however, there are also cases where guardians can be appointed even without consent being given.

Unstable living conditions or abuse are not the only reasons a guardian might be appointed. Parents themselves can apply for a ‘standby guardianship’ if they find themselves incapable of providing appropriate care to their child. The guardianship can either take effect once the parent is too sick to care for the child or at the time of the parent’s death.

“Guardianship for a person is the care given by an adult to someone unable to care for themselves. A guardian is typically a minor. The guardian has responsibility for the child and cares for it. They also make decisions regarding the daily life of the child. Legal custody of a child is given to guardians. Guardians often also have physical custody,” the guardianship attorneys further clarified.
